Processing of Personal Data

General Personal data refers to information relating to an identified or identifiable natural person. We primarily process personal data that we receive within the scope of our personnel recruitment and personnel administration from candidates, employees of Corroprot AG, and recruitment agencies, or that we collect from users during the operation of our website. We primarily process data provided directly by you. To the extent permitted and necessary, we also obtain certain data from publicly accessible sources or receive such data from authorities and other third parties. We obtain data about you from third parties, particularly through the following sources:

  • Information from public registers;

  • Information disclosed to us in connection with administrative and judicial proceedings (in connection with official proceedings, the statutory duty to report vacancies should also be noted: following notification of a reportable vacancy to the regional employment center [RAV/ORP], we may potentially receive your details if you are registered with the RAV);

  • Information relating to your professional functions and activities;

  • Information about you in correspondence and meetings with third parties;

  • Credit standing / solvency information;

  • Information about you provided to us by persons in your environment (family, advisors, legal representatives, etc.) so that we can conclude or perform contracts with you or involving you;

  • Information from banks, insurance companies, distribution partners, and other contractual partners of ours regarding the use or provision of services by you;

  • Information from media and the internet concerning your person;

  • Data in connection with the use of the website (e.g., IP address, MAC address of your smartphone or computer, details regarding your device and settings, cookies, date and time of visit, accessed pages and content, features used, referring website, location details). We use the personal data collected primarily for the personnel administration/management of Corroprot AG and to conclude and process contracts with you.

Data of Job Seekers and Applicants

If you search for suitable vacancies using the search field "Open Positions" ("offene Stellen"), you enter the relevant search term. When searching for jobs via the search box, we store your IP address. If you apply for a job posting via our website, you determine yourself which personal data you provide to us and which documents you upload. By submitting your application, you impliedly consent to the processing of your personal data for the purpose of assessing your application and forwarding it to the appropriate supervisor. If we employ you, the performance of the employment contract justifies the processing of data. In addition, Art. 328b of the Swiss Code of Obligations (CO) serves as a legal basis for data processing. If, following employment, an area of our data processing is not covered by another justifying reason and we intend to process your data further, we will always ask for your consent, specifying the purpose. By giving your consent, you expressly agree that we may store, process, and disclose the personal data you have communicated to us to employees of Corroprot AG for the specified purpose.

Data of Website Users

In connection with the use of this website, information such as IP address, location, operating system, browser type, etc., is routinely processed. Data processing is carried out to ensure user-friendliness and to provide you with the best possible service. In addition, we use data related to our website to continuously improve our services. In the area of our websites, we cooperate with IT service providers. Your data is stored and log files are analyzed to ensure relevant user navigation. The manner, scope, and purposes of data processing related to the use of our websites are addressed in the following section.

Further Potential Data Processing Activities

In addition, we process personal data of you and other persons, to the extent permitted and deemed appropriate by us, for the purposes listed below. We only process data where a corresponding legitimate interest exists and ensure the protection of your data:

  • Assertion of legal claims and defense in connection with legal disputes and official proceedings;

  • Prevention and investigation of criminal offenses and other misconduct (e.g., conducting internal investigations, data analysis for fraud prevention);

  • Ensuring the functioning of our operations, particularly IT systems, our websites, apps, and other platforms;

  • Video surveillance to safeguard domiciliary rights and other measures for IT, building, and facility security and the protection of our employees, other individuals, and assets entrusted to us (such as access controls, visitor logs, network and email scanners, telephone recordings);

  • Acquisition and sale of business divisions, companies, or parts of companies and other corporate transactions, and the associated transfer of personal data, as well as business management measures and compliance with legal and regulatory obligations and internal directives of ours;

  • Forwarding payment processing information in connection with statistical surveys;

  • Use within the framework of credit checks;

  • Forwarding data to our debt collection agency in the event of non-payment of outstanding claims. To the extent you have granted us consent to process your personal data for specific purposes, we process your data within the scope of and based on this consent, provided no other legal basis exists and where one is required. You may revoke consent granted to us at any time. However, this has no effect on data processing that has already taken place.

Cookies / Tracking and Other Technologies in Connection with the Use of Our Website

Cookies

To facilitate and improve the use of our website, we use "cookies" and comparable techniques on our websites that allow your browser or device to be identified. A cookie is a small file sent to your computer or automatically stored on your computer or mobile device by the web browser used when you visit our website. If you visit this website again, we can recognize you. However, such recognition does not allow us to draw conclusions about your individual identity. Alongside cookies that are only used during a session and deleted after your website visit ("session cookies"), cookies can also be used to store user settings and other information over a certain period (e.g., two years; "permanent cookies"). You can, however, configure your browser settings to reject cookies, store them for one session only, or delete them prematurely. Most browsers are preset to accept cookies. We use permanent cookies to better understand how you use our offerings and content, and to display tailored offers to you (which may also occur on websites of other companies; however, other companies only see that the same user who was on a specific page of ours is visiting their website). Certain cookies are set by us, while others are set by contractual partners with whom we collaborate. If you block cookies, certain functionalities may be limited or may no longer function. By using our website, you agree to the use of these techniques. If you do not wish to do so, you must configure your browser or email program accordingly. In addition to your consent, our use of cookies is based in particular on legitimate business interests, such as improving, personalizing, and developing services, marketing new features or products, and enhancing security.

Google Analytics

We occasionally use Google Analytics from Google LLC in the USA, www.google.com, on our websites. This service enables us to measure and evaluate the use of the website (in non-personally identifiable form). Permanent cookies set by the service provider are also used for this purpose. The service provider does not receive any personal data from us (and does not retain IP addresses), but can track your use of the website, combine this information with data from other websites you have visited that are also tracked by the service provider, and use these insights for its own purposes (e.g., advertising management). To the extent you have registered directly with the service provider, the provider is aware of your identity. The processing of your personal data by the service provider is then carried out under the provider's responsibility in accordance with its own data protection provisions. The service provider merely informs us how our respective website is used (no personal information about you).

Google AdWords

Furthermore, we use the analysis service Google AdWords and, within Google AdWords, Conversion Tracking on our website. Google AdWords places a cookie for conversion tracking on your computer's hard drive when you click on an ad served by Google. These cookies are not used for personal identification. If you visit certain pages of our website, Google and we can recognize that you clicked on the ad and were redirected to that page. The information obtained using these cookies is used to compile statistics for AdWords customers who utilize conversion tracking. Through these statistics, we learn the total number of users who clicked on the ad served by Google and accessed a page tagged with a conversion tracking tag. Further information on terms of use and data protection within the framework of Google AdWords can be found here: http://www.google.de/policies/technologies/ads.

Disclosure and Transfer of Data Abroad

Within the scope of our business activities and the purposes specified above, we also disclose data to third parties, to the extent permitted and deemed appropriate by us, whether because they process it on our behalf or because they intend to use it for their own purposes. This relates in particular to the following entities ("recipients"):

  • Service providers of ours (external, such as banks, insurance companies, including processors such as IT providers);

  • Domestic and foreign authorities, official agencies, or courts;

  • The public, including visitors to websites, social media, and other media;

  • Competitors, industry organizations, associations, federations, and other bodies (e.g., for training/certification registrations);

  • Acquirers or parties interested in acquiring business units or companies;

  • Other parties in potential or actual legal proceedings. These recipients are located in Switzerland or abroad. You must expect your data to be transferred to all countries in which Corroprot AG is represented by group companies, branch offices, or other offices, as well as to any other country where our business partners are located. If we transfer data to a country without adequate statutory data protection, we ensure an appropriate level of protection through suitable measures or rely on statutory exceptions such as consent, contract performance, the establishment, exercise, or enforcement of legal claims, overriding public interests, publicly available personal data, or because it is necessary to protect the life or physical integrity of the data subjects. You may request further information from us at any time. However, we reserve the right not to disclose sensitive data for reasons of data protection law or secrecy obligations.

Retention Period for Personal Data

We process and store your personal data for as long as necessary for the fulfillment of our contractual and legal obligations or otherwise for the purposes pursued by the processing, i.e., for example, for the entire duration of the business relationship (from initiation and execution through to the termination of a contract) as well as beyond that in accordance with statutory retention and documentation obligations. In this context, personal data may be stored for the period in which claims can be asserted against our company and to the extent we are otherwise legally required to do so or legitimate business interests require this (e.g., for evidence and documentation purposes). As soon as your personal data is no longer required for the aforementioned purposes or if you instruct us accordingly, it is generally and to the extent feasible deleted or anonymized.

Data Security

We protect your personal data through appropriate technical and organizational security measures and store it on secure servers. The website is secured against loss, destruction, manipulation, and unauthorized access, alteration, or dissemination using measures consistent with current technical standards. However, we assume no warranty or guarantee for the absolute security of your data. It is your responsibility to maintain an up-to-date backup copy of the transmitted data at all times and to store it independently of the website.

Obligation to Provide Personal Data You are under no obligation to provide us with your personal data. However, it is virtually impossible for us to collaborate with you and provide our services if you do not supply us with your data. Within our business relationship, we rely on the personal data necessary to initiate and conduct a business relationship and to fulfill the associated contractual obligations. Without this data, we will not be able to conclude or execute a contract with you (or the entity or person you represent). Furthermore, the website cannot be used if certain information required to ensure data traffic (such as IP addresses) is not disclosed.

Your Rights

Within the scope of the data protection law applicable to you and to the extent provided therein, you have the right to information/access, rectification, erasure, the right to restrict data processing, the right to object to our data processing activities, and the right to obtain delivery of certain personal data for the purpose of transmission to another entity. Please note, however, that we reserve the right to assert statutory restrictions on our part, for example where we are legally obligated to retain or process certain data, have an overriding interest, or require it for the assertion of legal claims. In the event that costs arise for you, we will inform you in advance. We have already informed you above regarding the option to revoke your consent. Please note that exercising these rights may conflict with contractual arrangements and may lead to consequences such as early contract termination or cost implications. We will inform you in advance in such cases where this is not already contractually governed. Exercising such rights generally requires that you clearly verify your identity (e.g., by providing a copy of an ID where your identity is otherwise not clear or cannot be verified).

Amendments

We may amend this Privacy Policy at any time without prior notice. The current version published on our website shall apply. Insofar as the Privacy Policy is part of an agreement with you, we will inform you of the change by email or by other appropriate means in the event of an update.
